Prior to allegedly helping Justin J. Wilson brutally torture his estranged wife for six days inside a Broadalbin trailer, Nicole K. Elmore, 35, requested–and was granted–a “stay away” order of protection against Wilson, according to records in the Town of Perth Court.
Wilson, 31 of Gloversville, allegedly violated that order, issued September 7, 2021, by Fulton County Family Court, several times, resulting in at least three misdemeanor criminal charges against him, according to court documents. The most recent violation of the order of protection came on December 23, just about a week before the alleged torture took place, court records show. At the time of the alleged sexual and physical abuse in the trailer, Wilson had been free on bail, making $10,000 bail in the Town of Perth Court, $10,000 in Fulton County Family Court, and $1,000 in the Town of Johnstown Court, according to a Town of Perth official who did not want to be identified.
In a November 29 statement made to New York State Police at the Mayfield station, Elmore outlines a complicated and often violent relationship with Wilson–a relationship that, based on court documents, appears to have continued despite the protection order and violations against it.
In the statement, Elmore said that she and Wilson had been involved in a relationship, and in May 2021 he moved into her trailer on County Route 107–where the alleged torture of Wilson’s estranged wife occurred. Elmore told state police that in August of 2021, pneumonia landed her in the hospital for about two weeks, during which time Wilson was supposed to be caring for Elmore’s children, aged 8, 12,13 and 15.
In her statement, Elmore alleges Wilson stole $10,000 from her bank account, “because he had my pin number,” and sexually assaulted her 13-year-old daughter–a matter that she said was handled through Fulton County Family Court. The Gazette/Leader-Herald was not able to obtain Family Court records. Elmore’s court order of protection against Wilson was issued September 7 with an expiration date of March 7, 2022, according to Town of Perth Court records.
Elmore told police that after she got out of the hospital, she had conversations with Child Protective Services.
“I began meeting with C.P.S. and I was doing really well at keeping him away,” according to her statement. “I’m not really sure what happened, but he started coming back around again. It has been really hard trying to let him go.”
Elmore told police that C.P.S. took her children to live with her sister in Troy in early November, “because of Justin always being around.”
Court records show Wilson allegedly violated the court order of protection on November 11, resulting in a misdemeanor charge. In her November 29 statement, Elmore said she helped collect $5,000 to pay Wilson’s bail in the case from Wilson’s brothers (“He calls them his brothers, but I don’t know if they really are.”)
Then, about a week before her November 29 statement, Elmore said she and Wilson got into an argument while driving around Gloversville in search of cannabis and crack in her red 2009 Chevrolet Silverado. She said she parked and tried to leave.
“He grabbed me by the sweater and put something hard into my back and told me he was going to [expletive] kill me,” her statement reads. “I think it was a gun. It was hard and circular, and he pressed it into my back.”
In her statement, Elmore also alleges Wilson brought a 12-gauge shotgun into her house, but he told her he wanted to get rid of it because he knew it was stolen.
After the fight in the vehicle in Gloversville, Elmore said she and Wilson continued to talk and see each other. She said she spent Thanksgiving with her kids in Troy, and Wilson was upset that he had to spend Thanksgiving alone, prompting him to take her phones and house keys, according to Elmore’s statement.
The duo spent the next few days together, going to “known drug houses in Gloversville,” and eating at a diner, Elmore’s statement reads.
But then, on the afternoon of November 28, Elmore said Wilson became erratic, throwing things around the home, prompting her to leave around 3 p.m.
“I’m done with Justin, and I want my kids back,” Elmore told police on November 29.
However, police allegedly found Wilson in the passenger seat of Elmore’s vehicle following an accident at the intersection of County Highway 158 and County Highway 107 at about 1:55 p.m. in the Town of Perth on December 23.
The alleged torture at Elmore’s trailer began New Year’s Eve.
Both Wilson and Elmore were arraigned on January 7. Wilson and Elmore have both been charged with kidnapping, assault with the intent to disfigure and aggravated sexual abuse, all felony charges, according to court documents. Wilson and Elmore pleaded not guilty on Friday and were remanded without bail and sent to Fulton County Jail.
The victim’s supporting deposition statement made to state police on Jan. 7 says Elmore “was involved with everything.”
Chris Savino, the attorney for Elmore, could not be reached for comment on Monday.
Wilson’s attorney, Stephen Rockmacher, said he has spoken with Wilson several times in the past few days, but he can’t comment on the case.
“I’m not at liberty to discuss our attorney-client conversations at this point,” Rockmacher said.
Rockmacher said the case would be transferred out of Town of Perth Court to county-level court in the next week or so.
